5 Steps To File Chapter 7 in California

If you're feeling overwhelmed by bills, collection calls, or the stress of making ends meet, you're not alone. Many people turn to bankruptcy when they've tried everything else and still can't get ahead.

Filing Chapter 7 in California involves a few steps — gathering your financial documents, completing two short courses, filing your paperwork, and attending a brief meeting with a trustee. Many people do it successfully without a lawyer. This guide walks you through each step so you know exactly what to expect.

Step 1: See If You Qualify

Chapter 7 has income limits, but most people who need it meet them. You'll answer a few questions about your household size and income. If you use Upsolve's free tool, it just takes two minutes to see if you qualify.

Start here →

If your income is below California’s median for a household your size, you'll likely pass the means test and qualify to file with Upsolve.

Step 2: Gather Your Documents

Before you file, you'll need to pull together a few key documents. One of those is a certificate from a short credit counseling course, which you'll complete online. It takes 1–2 hours and costs $10–$50 (fee waivers available).

See the full document checklist →

Step 3: Complete Your Forms and File

The forms you'll fill out are federal, so they're the same across the country. You can find them as free fillable PDFs at uscourts.gov.

If you use Upsolve, your forms are generated for you based on your answers and organized so they’re ready to print and sign.

How filing works with Upsolve →

California is divided into four districts — Northern, Central, Eastern, and Southern — and each one has its own rules and local forms. In every district, you can file your forms by mail or by bringing them to the courthouse. Some districts also allow you to file your forms online.

You’ll find details about each district’s filing process later in the California Bankruptcy Districts section.

Filing Fee Information & Fee Waiver Eligibility

There’s a $338 filing fee for Chapter 7. If you can’t afford it, you can ask the court to waive the fee when you file your paperwork.

You may be eligible for a fee waiver if your household income is below 150% of the federal poverty level and you can’t afford to pay the fee in installments. A bankruptcy judge will review your income and expenses and decide whether to grant it.

California Fee Waiver Eligibility for Cases Filed In 2026Eligible for fee waiver when under 150% the poverty level.
Household SizeState Poverty LevelFee Waiver Limit (150% PL)
1$1,330.00$1,995.00
2$1,803.33$2,705.00
3$2,276.67$3,415.00
4$2,750.00$4,125.00
5$3,223.33$4,835.00
6$3,696.67$5,545.00
7$4,170.00$6,255.00
8$4,643.33$6,965.00
9$5,116.67$7,675.00
10$5,590.00$8,385.00

If you don’t qualify for a fee waiver, you’ll need to pay the full filing fee or an installment payment (if approved) when you file your forms.

We’ll cover how to pay the filing fee where you live in the California Bankruptcy Districts section below.

Step 4: Attend Your 341 Meeting

About a month after you file, you'll have a short meeting with your bankruptcy trustee on Zoom. It typically takes about five minutes. The trustee will verify your identity and ask a few basic questions about your paperwork.

Upsolve can help you prep for your 341 meeting →

Step 5: Get Your Discharge

After your 341 meeting, you'll need to take one more short course — a debtor education course on budgeting and managing credit. Once that's done and any follow-up is resolved, the court erases your eligible debts. That's your fresh start, usually within 3–4 months of filing.

California Bankruptcy Districts

California has four bankruptcy districts: Northern, Central, Eastern, and Southern. Each district has its own court and filing rules, and each one is split into divisions. The courthouse that handles your case depends on the county you live in, so you can find your county in the district sections below to see where to file.

You can also use the court locator tool, which lets you search by ZIP code.

Northern District Local Forms/Requirements

If you’re filing without a lawyer in the Northern District of California, you can file your paperwork in person or by mail.

Each division serves different counties. The correct address depends on where you live and how you're filing:

📍 Santa Rosa Division

  • Serves Del Norte, Humboldt, Lake, Marin, Mendocino, Napa, and Sonoma counties

  • The Santa Rosa courthouse is currently closed to visitors and does not accept mail or deliveries. Filers in this division submit their paperwork to the Oakland Division instead.

  • Filing address (use Oakland): U.S. Bankruptcy Court 1300 Clay Street, Suite 300 Oakland, CA 94612

📥 A document drop box is available in the lobby on the 2nd floor from 7:00 AM to 4:30 PM.

📍 San Francisco Division

  • Serves San Francisco and San Mateo counties

  • Mailing address: U.S. Bankruptcy Court Phillip Burton Federal Building & U.S. Courthouse 450 Golden Gate Avenue, Mailbox 36099 San Francisco, CA 94102

📥 A document drop box is available on the 3rd floor from 7:30 AM to 5:00 PM.

The Northern District requires filers to submit a creditor matrix, which is a list of all the people and companies you owe money to. It must follow specific formatting rules so the court can notify your creditors about your case. You’ll also need to include a signed Creditor Matrix Cover Sheet with your filing.

💰 You can pay your filing fee with a money order or cashier’s check for the exact amount made out to Clerk, U.S. Bankruptcy Court. You can also pay online at Pay.gov with a debit card or PayPal.

🚫 The court does not accept credit cards, cash, or personal checks.

Central District Local Forms/Requirements

If you’re filing without a lawyer in the Central District of California, you can file your paperwork in person or by mail. You can also prepare your forms online with the court’s free Electronic Self-Representation (eSR) tool.

📅 Appointments are required for in-person visits. Schedule an appointment here.

Each division serves different counties. The correct address depends on where you live:

📍 Los Angeles Division

  • Serves most of Los Angeles County

  • Filing address: U.S. Bankruptcy Court Edward R. Roybal Federal Building and U.S. Courthouse 255 East Temple Street Los Angeles, CA 90012

📍 Riverside Division

  • Serves Riverside and San Bernardino counties

  • Filing address: U.S. Bankruptcy Court 3420 12th Street Riverside, CA 92501

📍 Santa Ana Division

  • Serves Orange County

  • Filing address: U.S. Bankruptcy Court Ronald Reagan Federal Building and U.S. Courthouse 411 West Fourth Street Santa Ana, CA 92701

📍 Northern Division

  • Filing address: U.S. Bankruptcy Court 1415 State Street Santa Barbara, CA 93101

📍 San Fernando Valley Division

  • Serves portions of Los Angeles and Ventura counties

  • Filing address: U.S. Bankruptcy Court 21041 Burbank Boulevard Woodland Hills, CA 91367

The Central District requires filers to submit a creditor matrix. This is a list of everyone you owe money to, along with their mailing addresses. It must follow specific formatting rules so the court can notify your creditors about your case. In addition, you’ll need to include a signed Master Mailing List Verification Form with your filing.

💰 You can pay your filing fee with a money order or cashier’s check made out to Clerk, U.S. Bankruptcy Court.

If the court approves you to pay in installments, your first payment must be made by mail or in person. After that, you can make the remaining payments online through Pay.gov using a bank account (ACH).

🚫 The court does not accept credit cards, cash, or personal checks.

💻 Online filing option: The court’s free Electronic Self-Representation (eSR) tool walks you through preparing your bankruptcy forms online. You’ll have up to 45 days to finish. After you submit your forms, you’ll get a confirmation email listing everything you need to deliver or mail to the court within 10 days, including:

🚨 Your case isn’t filed, and the automatic stay doesn’t begin, until the court receives everything and issues your case number.

📤  After your case is open, you can upload documents that don’t require a fee, like amendments or proof of income, through the court’s Electronic Drop Box (EDB). You’ll need to apply for access first.

Eastern District Local Forms/Requirements

If you’re filing without a lawyer in the Eastern District of California, you can file your paperwork in person or by mail. You can also prepare your forms online with the court’s free Electronic Self-Representation (eSR) tool.

Each division serves different counties. The correct address depends on where you live:

📍 Fresno Division

  • Serves Fresno, Inyo, Kern, Kings, Madera, Mariposa, Merced, and Tulare counties

  • Filing address: U.S. Bankruptcy Court 2500 Tulare Street, Suite 2501 Fresno, CA 93721

📍 Sacramento Division

  • Serves Alpine, Amador, Butte, Calaveras, Colusa, El Dorado, Glenn, Lassen, Modoc, Mono, Nevada, Placer, Plumas, Sacramento, San Joaquin, Shasta, Sierra, Siskiyou, Solano, Stanislaus, Sutter, Tehama, Trinity, Tuolumne, Yolo, and Yuba counties

  • Filing address: U.S. Bankruptcy Court Robert T. Matsui U.S. Courthouse 501 I Street, Suite 3-200 Sacramento, CA 95814

The Eastern District requires filers to submit a Master Address List, also known as a creditor matrix. This is a list of everyone you owe money to, including their mailing addresses. It has to follow strict formatting rules so the court can send notices about your case. You’ll also need to include a signed Verification of Master Address List with your paperwork.

To make the Master Address List easier, the court offers a simple online tool to help you create a properly formatted list. You can use it at the clerk’s office or from home.

💰 You can pay your filing fee with a money order or cashier’s check made out to Clerk, U.S. Bankruptcy Court. If you pay in person, you can also use a debit card.

If the court approves you to pay in installments, you can make your payments online through Pay.gov using a bank account, debit card, or PayPal.

🚫 The court does not accept credit cards, cash, or personal checks.

💻 Online filing option: The court’s free Electronic Self-Representation (eSR) tool walks you through preparing your Chapter 7 forms online, and you’ll have up to 45 days to finish. After you submit your forms, you’ll get a confirmation email with instructions for sending in the remaining documents, including:

You can upload these through the court’s online Debtor Drop Box or deliver or mail them to the court. The drop box can’t accept payments, so your filing fee needs to be mailed or delivered in person.

🚨 Your case isn’t filed, and the automatic stay doesn’t begin, until the court receives these documents and issues your case number.

Southern District Local Forms/Requirements

If you’re filing without a lawyer in the Southern District of California, you can file your paperwork in person or by mail. You can also prepare your forms online with the court’s free Electronic Self-Representation (eSR) tool.

🪪 You’ll need to prove your identity when you file. If you file in person, show a government-issued photo ID, like a driver’s license or passport, at the intake counter. If you mail your forms or someone else drops them off for you, include a copy of your ID.

📍 San Diego Division

  • Serves Imperial and San Diego counties

  • Filing address: U.S. Bankruptcy Court Jacob Weinberger U.S. Courthouse 325 West F Street San Diego, CA 92101

The Southern District requires all filers to submit a creditor matrix. This is a list of everyone you owe money to, along with their mailing addresses. It must follow specific formatting rules so the court can notify your creditors about your case.

You’ll need to file a paper copy of your list and also submit it electronically. You can do the electronic part in one of three ways:

  • Enter your creditors using the court’s online tool.

  • Save your list as a .txt file on a USB drive and give it to the intake clerk at the courthouse.

  • Enter your creditors on the public computers at the courthouse.

💰 You can pay your filing fee by money order or cashier’s check made out to Clerk, U.S. Bankruptcy Court. If you visit the court in person, exact cash is also accepted. Once you have a case number, you also have the option to pay online through Pay.gov using a debit card or PayPal.

📆 If you can’t pay the full fee at once, you can ask to pay in up to four installments over 120 days. This district uses its own local form for this request, CSD 1006, which you’ll file with your bankruptcy forms. If you miss an approved payment, the court may dismiss your case.

🚫 The court does not accept credit cards or personal checks.

💻 Online filing option: The court’s free Electronic Self-Representation (eSR) tool walks you through preparing your Chapter 7 forms online. You’ll have up to 45 days to finish. After you submit your forms, you’ll need to mail or hand-deliver these items to the court:

🚨 Your case isn’t filed, and the automatic stay doesn’t begin, until the court receives these documents and issues your case number.
